HANGOUT DREAMSPOT is registered in South Africa as FastRyd (Pty) Ltd and based in Cape Town.

Terms and Conditions

Our Content Standards and Guidelines help us to keep everything on our Platform relevant to and appropriate for our global audience, without limiting freedom of expression. They tell you how we manage content and take action against anything inappropriate.

By agreeing to our Terms, you’re agreeing to everything in all three documents. If you don’t accept any of these Terms, please do not use our Platform.

All this information is important because it (along with your booking confirmation email and any contractual information provided before you book) sets out the legal terms on which Service Providers offer their Travel Experiences through our Platform.

If something goes wrong with your Travel Experience, these Terms explains what you can do about it. This includes making a complaint to us, going to court, and (in some cases) using an online dispute resolution service.

If you want to appeal a moderation decision, or report any content on our Platform, our Content Standards and Guidelines explain how to do so and how we manage these requests.

We encourage you to read each section in full.

Definitions

 Some of the words you’ll see have very specific meanings, so check out the “Hangout Dreamspot dictionary” at the end of these Terms.

 About these terms

  1. When you complete your Booking, you accept these Terms and any other ones that you’re provided with during the booking process.
  2. If any authority decides that some of these terms are unlawful, the rest of the terms will continue to apply.
  3. These Terms are laid out like this.

We reserve the right to audit any and all accounts in the Rewards & Wallet program at any time and without notice to the Member to ensure compliance with the Rewards & Wallet program or investigate (alleged) fraud or misuse.

A14. Intellectual property rights

  1. Unless otherwise stated, all rights in our Platform (technology, content, trademarks, look and feel, etc.) are owned by Hangout Dreamspot, and by using our Platform you agree to do so for its intended purpose only and respecting the requirements set out below in paragraphs A14.2 and A14.3.
  2. You’re not allowed to monitor, copy, scrape/crawl, download, reproduce, or otherwise use anything on our Platform for any commercial purpose without written permission of Hangout Dreamspot .
  3. We keep a close eye on every visit to our Platform, and we’ll block anyone (and any way automated system) we suspect of:

 -conducting an unreasonable amount of searches using any device or software to gather prices or other information

– doing anything that places undue stress on our Platform.

  1. By uploading a review/picture to our Platform, you’re confirming that it meets our Content Standards and Guidelines and that:

– it’s truthful (e.g. you haven’t altered the picture or uploaded one of a different property)

– it doesn’t contain any viruses

– you’re allowed to share it with us

– you own (or are allowed to use) any intellectual property rights that it contains

– we’re allowed to use it on our Platform and for any other commercial purposes (including marketing and advertising), on any media, worldwide—unless you ask us to stop using it

– it doesn’t infringe the privacy rights of other people

-you accept full responsibility for any legal claims against Hangout Dreamspot related to it.

  1. Just to be clear, we’re not responsible or liable for any picture uploaded to our Platform, and we’re allowed to remove any picture at our discretion (e.g. if a picture does not meet the above criteria).

SECTION A

General terms for all types of Travel Experiences.

If there’s any discrepancy between general and specific terms, the specific terms will apply.

The English version of these Terms is the original. If there’s any dispute about the Terms, or any mismatch between the Terms in English and in another language, the Terms as they appear in English will apply, unless local law requires otherwise.

 Modification clause

  1. We may make changes to these Terms. Where such changes are material, we will inform you in advance of such changes becoming effective, unless the changes are required by applicable law.
  2. If you do not accept the changes, please do not use our Platform.
  3. Otherwise, your continued use of our Platform after the effective date of the proposed changes will constitute your acceptance of the revised Terms.
  4. Any existing Bookings will continue to be governed by the Terms that applied when the Booking was made.

B1. Scope of this section

  1. This section contains the specific terms for Accommodations products and services. It applies as well as section A (which applies to all Travel Experiences).

B2. Contractual relationship

  1. When you make (or request) a Booking, it’s directly with the Service Provider—we’re not a “contractual party.”
  2. Hangout Dreamspot owns and operates the Platform.
  3. Our Platform only shows Accommodations that have a commercial relationship with us (in some cases, through a partner.
  4. Information about Service Providers (e.g. facilities, house rules, sustainability measures) and their Travel Experiences (e.g. prices, availability, and cancellation policies) is based on what they provide to us.

A3. About Hangout Dreamspot

  1. When you book an accommodation, flight, or tours, Hangout Dreamspot provides and is responsible for the Platform, but not the Travel Experience itself (see A4.4 below).
  2. When you book a rental car or private or public transportation, Hangout Dreamspot provides and is responsible for the Platform, but not the Travel Experience itself (see A4.4 below).
  3. We work with companies that provide local support services (e.g. Customer Support or account management). They don’t:

– control or manage our Platform

– have their own Platform

– have any legal or contractual relationship with you

– provide Travel Experiences

– represent us, or enter into contracts or accept legal documents in our name

operate as our “process or service agents.”

A4 Our Platform

  1. We get information from Service Providers, and we can’t guarantee that everything is accurate—but when providing our Platform, we take reasonable care and act with professional diligence. Unless we’ve failed to do so, or have been negligent, we can’t be held responsible for any errors, interruptions, or missing bits of information. Of course, we’ll do everything we can to correct/fix them as soon as we become aware of them.
  2. We’re always working to improve our customers’ experience with Hangout Dreamspot . So sometimes, we show different people different designs, phrasings, products, etc. to find out how they react. As a result, you might not come across some services or conditions when you visit our Platform.
  3. Our Platform is not a recommendation or endorsement of any Service Provider or its products, services, facilities, vehicles, etc.
  4. We’re not a party to the terms between you and the Service Provider. The Service Provider is solely responsible for the Travel Experience.
  5. To make a Booking, you may need to create an Account. Make sure all your info (including payment and contact details) is correct and up to date, or you might not be able to access your Travel Experience(s). You’re responsible for anything that happens with your Account, so don’t let anyone else use it and keep your username and password secret.
  6. We’ll show you the offers that are available to you, in (what we think is) the right language for you. You can change to another language whenever you like.
  7. Unless otherwise indicated, you need to be at least 18 to use the Platform.

A5. Our values

  1. You will:

– abide by Our values

– comply with all applicable laws

– cooperate with any anti-fraud/anti-money laundering checks we need to carry out

– not use the Platform to cause a nuisance or make fake Bookings

– use the Travel Experience and/or Platform for their intended purpose

– not cause any nuisance or damage, and not behave inappropriately to the Service Provider’s personnel (or anyone else, for that matter).

A6. Prices

  1. When you make a Booking, you agree to pay the cost of the Travel Experience, including any taxes and charges that may apply.
  2. Some of the prices you see may have been rounded to the nearest whole number. The price you pay will be based on the original, “non-rounded” price (although the actual difference will be tiny anyway).
  3. Obvious errors and obvious misprints are not binding. For example, if you book a premium car or a night in a luxury suite that was mistakenly offered for $1, your booking may be canceled and we’ll refund anything you’ve paid.
  4. A crossed-out price indicates the price of a like-for-like Booking without the price reduction applied (“like-for-like” means same dates, same policies, same quality of accommodation/vehicle/class of travel, etc.)

A7. Payment

  1. For some products/services, the Service Provider will require an Upfront Payment and/or a payment taken during your Travel Experience.

If we organize your payment, we (or, in some cases, our affiliate) will be responsible for managing your payment and ensuring the completion of your transaction with our Service Provider. In this case, your payment constitutes final settlement of the “due and payable” price.

If the Service Provider charges you, this will usually be in person at the start of your Travel Experience, but it could also be (for example) that your credit card is charged when you book, or that you pay when you check out of your Accommodation. This depends on the Upfront Payment policy of the Service Provider as communicated to you in the booking process.

  1. If the Service Provider requires an Upfront Payment, it may be taken or per-authorized when you make your Booking, and it may be non-refundable. Before you book, check the Service Provider’s Upfront Payments policy (available during the booking process), which we don’t influence and aren’t responsible for. This does not affect your rights if you have any problems with your Travel Experience.
  2. If your payment method is denominated in a currency* that is different from the payment currency, your bank or payment method provider (or their payment services providers) may charge you additional fees. For example, this could happen if your credit card is in Euros but your hotel is charging you in dollars or South African Rand. If this is going to happen, we’ll inform you during the booking process.
  3. This just refers to the default currency of your payment method.
  4. If you know of or suspect any fraudulent behavior or unauthorized use of your Payment Method, please contact your payment provider as soon as possible.
  5. If the currency selected on the Platform isn’t the same as the Service Provider’s currency, we may:

– show prices in your own currency

– offer you the Pay In Your Own Currency option.

  1. Pay In Your Own Currency. We (and/or one of our affiliates) may provide you with the ability to pay for your Booking in your own currency (your “Home Currency”), based on your location and/or account setting—and in respect of this service only, we do this as principal, rather than as agent for the Service Provider. Where you use this service, you agree to the following terms, which are separate from your contract with the Service Provider related to your Travel Experience. The Service Provider is not involved in the provision of the Pay In Your Own Currency service and is not party to the following terms, which do not give you any extra rights under your contract with the Service Provider. If you choose to pay in the Service Provider’s currency, the following terms don’t apply.

For the avoidance of doubt, when you use Pay In Your Own Currency, we are simply enabling you to make payment in your own currency while we ensure that the Service Provider is paid in their local currency. As such, you are not making payment in one currency and receiving another currency.

If you choose to use Pay In Your Own Currency, all fees and charges from us for use of the Pay In Your Own Currency service either (a) are included in the exchange rate or (b) appear as a separate line item (included in the total price displayed where applicable) during the check-out process.

The exchange rate is determined at the time the total payment (or estimated total payment) is displayed during the check-out process—and where applicable, the total price displayed will be the amount charged by us to you. Just to be clear, certain fees and charges that are part of the total price displayed will, however, be collected directly by the Service Provider. We will tell you during the check-out process when this is the case.

If you cancel a reservation within any permitted cancellation period which may apply, we will refund you the exact same amount we initially charged you (inclusive of any applicable fees in relation to the Pay in Your Own Currency Service).

  1. We’ll store your Payment Method details for future transactions after collecting your consent.

A8. Policies.

  1. When you make a Booking, you accept the applicable policies as displayed in the booking process. You’ll find each Service Provider’s cancellation policy and any other policies (about age requirements, security/damage deposits, additional supplements for group Bookings, extra beds, breakfast, pets, cards accepted, etc.) on our Platform: on the Service Provider information pages, during the booking process, in the fine print, and in the confirmation email or ticket (if applicable).
  2. If you cancel a Booking or don’t show up, any cancellation/no-show fee or refund will depend on the Service Provider’s cancellation/no-show policy.
  3. Some Bookings can’t be canceled for free, while others can only be canceled for free before a deadline.
  4. If you book a Travel Experience by paying in advance (including all price components and/or a damage deposit if applicable), the Service Provider may cancel the Booking without notice if they can’t collect the balance on the date specified. If they do cancel, any non-refundable payment you’ve made will only be refunded at their discretion. It’s your responsibility to make sure the payment goes through on time, that your bank, debit card, or credit card details are correct, and that there’s enough money available in your account.
  5. If you think you’re not going to arrive on time, contact your Service Provider and tell them when they can expect you. It’s your responsibility to ensure you’re on time—and if you aren’t, we are not responsible for any associated costs (e.g. the cancellation of your Booking, or any fees the Service Provider may charge).
  6. As the person making the Booking, you are responsible for the actions and behavior (in relation to the Travel Experience) of everyone in the group. You’re also responsible for obtaining their permission before providing us with their personal data.

A9. Privacy and cookies

  1. If you book an accommodation, flight, or attraction, read our Privacy and Cookie Notice for more info on privacy, cookies, and how we might contact you and process personal data
  2. If you book ground transportation, see the Privacy Statement as applicable to find out how we process your personal data.

A10. Accessibility requests

  1. If you have any accessibility requests:

– about our Platform and/or services, contact our Customer Service team

– about your Travel Experience (wheelchair access, walk-in baths, etc.), contact your Service Provider or the airport , etc.

A11. Insurance

  1. If you bought insurance through , refer to the policy document(s) for the terms and for further info. These Terms do not apply to us

A13. Rewards, Credits, & Wallet

  1. We may issue Promotional Rewards to you—at our sole discretion and subject to any Individual Reward Criteria that apply. If we make a clerical error (i) in calculating your Rewards or (ii) in converting currencies related to your Rewards, we can always change or correct any balances shown.
  2. How to get Rewards. You may, for example, earn and receive a Reward by booking and completing Accommodation stays with participating Service Providers, or by making a certain number of Eligible Bookings in a given time period. Note that the amount/quantity of Rewards earned will depend on each promotional campaign. We’ll provide details about earning/spending a Reward when it becomes available to earn and/or spend.
  3. Where to find your Rewards. If and when you receive any Rewards, you will be able to manage and spend them from the Wallet, which is automatically created when you create a verified Account. You’ll find the Wallet in your Account menu, and you must be signed in to your Account to access it. If you need to do anything to receive a Reward, we’ll tell you how (through Account notifications, push notifications, and/or emails). Once you have Rewards in your Wallet, we’ll provide any terms and conditions related to spending them.
  4. Types of Rewards. Although we only award (a) Credits and (b) vouchers into your Wallet, your Wallet may also help you track the processing of (c) other types of Reward (e.g. Credit Card Cashback) from us. We’ll tell you what you need to know about receiving each Reward at the appropriate time.
  5. How to get Credits. Credits are usually issued as a result of getting a Reward, but we may issue Credits for other reasons.
  6. Where to find your Credits. Your Rewards are always stored in the Wallet until they are spent. Your Wallet balance will indicate how much is stored and spendable on Eligible Bookings. You will also be able to access detailed information such as when your Rewards were earned, were awarded, and will expire. If you’re entitled to Cash Credits, you’ll also find out how to transfer them to a credit or debit card (of certain brands).
  7. Types of Credits. Each Reward type has its own set of spending and/or usage conditions. In general, all Rewards can only be spent on Travel Experiences that accept Wallet payments. Travel Credits can be spent across different bookings, but vouchers can only be spent on specific Bookings stated within each voucher’s terms and conditions. Cash Credits can also be spent like Travel Credits or be transferred to a credit or debit card (of certain brands).

A15. What if something goes wrong?

  1. If you have a question or complaint, contact our Customer Service team. You can do so by accessing your Booking through our website or through our Help Center. You can help us help you as quickly as possible by providing:

– your Booking confirmation number, your contact details, and the email address you used when you made your Booking

– a summary of the issue, including how you’d like us to help you

– any supporting documents (e.g. bank statement, pictures, receipts, etc.)

  1. All questions and complaints are recorded, and the most urgent ones are treated as highest priority.
  2. We do try to resolve disputes with you directly, and we’re not obliged to submit to any alternative dispute resolution procedures handled by independent providers.
  3. You may also bring legal proceedings before a competent court.

A16. Communication with the Service Provider

  1. We may help you communicate with your Service Provider, but that doesn’t mean we’re taking responsibility for the Travel Experience or anything the Service Provider does/doesn’t do. We can’t guarantee that they will read anything from you or that they’ll do what you ask. In itself, the fact that you contact them or they contact you doesn’t mean you have any grounds for legal action. If you need help, contact us via our Help Center.

A17. Measures against unacceptable behavior

  1. If you breach these Terms (including our values and our Content standards and guidelines) or fail to comply with applicable laws or regulations, we have the right to:

– stop you making any Bookings,

– -cancel any Bookings you’ve already made,

-stop you using:

-our Platform,

-our Customer Service,

-your Account

  1. If we cancel a Booking as a result, you may not (depending on the circumstances) be entitled to a refund. We may tell you why we canceled your Booking, unless telling you would (a) contravene applicable laws and/or (b) prevent or obstruct the detection or prevention of fraud or other illegal activities. If you believe we incorrectly canceled your Booking, contact our Customer Service team.

A18. Limitation of liability

  1. Nothing in these Terms will limit our (or the Service Provider’s) liability (i) when we (or they) were negligent and this led to death or personal injury; (ii) in case of fraud or fraudulent misrepresentation; (iii) in respect of gross negligence or willful misconduct; or (iv) if such liability can otherwise not lawfully be limited or excluded.
  2. If you are in breach of these Terms and/or the Service Provider’s terms, we won’t be liable for any costs you incur as a result.
  3. We are not liable for:

– any losses or damages which were not reasonably foreseeable when you made your Booking or otherwise entered into these Terms; or

– any event which was reasonably beyond our control.

  1. We don’t make any promises about Service Providers’ products and services apart from what we expressly state in these Terms, for example in Section A4.
  2. To the extent permitted by law, the most that we (or any Service Provider) will be liable for (whether for one event or a series of connected events) is your reasonably foreseeable losses or damages in connection to your Booking(s).
  3. Just to be clear, these Terms are between you and us. Nothing in these Terms will entitle any third party other than the Service Provider to anything.
  4. You may be protected by mandatory consumer protection laws and regulations, which guarantee you rights that no company’s terms can overrule. If there is any inconsistency between those laws and regulations and these Terms, such mandatory consumer protection laws and regulations will override.

Terms of Accommodation Services

If your country of residence or establishment is within Africa, the Terms of Service for African Users apply to you.

If your country of residence or establishment is outside Africa, the Terms of Service for Users outside Africa apply to you.

If your country of residence or establishment is in Australia, the Terms of Service for Australian Users apply to you.

These Terms of Service (“Terms”) are a binding legal agreement between you and Hangout Dreamspot that govern the right to use the website, and other offerings from Hangout Dreamspot (collectively, the “Hangout Dream spot”). When used in these Terms, “Hangout Dreamspot,” “we,” “us,” or “our” refers to the Hangout Dreamspot entity with whom you are contracting.

The Hangout Dreamspot Platform enables users (“Members”) to publish, offer, search for, and book services. Members who publish and offer services are “Service Providers” and Members who search for, book, or use services are “Users or Guests.” Hosts offer accommodations (“Accommodations”), activities, excursions, and events (“Experiences”), and a variety of travel and other services (collectively, “Host Services,” and each Host Service offering, a “Listing”). As the provider of the Hangout Dreamspot Platform, Hangout Dreamspot does not own, control, offer or manage any Listings or Host Services. Hangout Dreamspot is not a party to the contracts entered into directly between Service Providers and Users, nor is Hangout Dreamspot a real estate broker, or insurer. Hangout Dreamspot is not acting as an agent in any capacity for any Member, except as specified in the Payments Terms of Service (“Payment Terms”).

We maintain other terms and policies that supplement these Terms like our Privacy Policy, which describes our collection and use of personal data, and our Payments Terms, which govern any payment services provided to Members by the Hangout Dreamspot payment entities (collectively “Hangout Dreamspot Payments”).

What we will do

  1. We provide the Platform on which Service Providers can promote and sell their Accommodations, and you can search for, compare, and book them. We offer a personalized experience based on how you use our Platform (including what you tell us), so you can book your ideal Accommodation with us. Our Platform allows you to discover Accommodations all over the world—and our search results make it easy to home in on the one that’s right for you.
  2. Once you’ve booked your Accommodation, we confirm the details of your Booking to both you and the Service Provider, including the names of the guest(s).
  3. Depending on the terms of your Booking, you may be able to change or cancel it if you want. Contact us using the Help Center (available 24 hours a day) if you need help with anything.

What you need to do

  1. Fill in all your contact details correctly, so we and/or the Service Provider can provide you with info about your Booking and, if necessary, contact you.
  2. Read these Terms and the terms displayed during the booking process carefully.
  3. Take care of the Accommodation and its furniture, fixtures, electronics, and other contents, and leave things in the same state they were in when you got there. If anything is broken, damaged, or lost, make sure you report it to the staff there as soon as you can, before you check out.

Maintain the security of the Accommodation and its contents during your stay. So, for example, don’t leave doors or windows unlocked.

Guest Terms

  1. Searching and Booking on Hangout Dreamspot

1.1 Searching. You can search for Host Services by using criteria like the type of Host Service, type of listing, travel destination, travel dates, and number of guests. You can also use filters to refine your search results. Search results are based on their relevance to your search and other criteria. Relevance considers factors like price, availability, Reviews, customer service and cancellation history, popularity, previous trips and saved Listings, Host requirements (e.g. minimum or maximum nights), and more. Learn more about search results in our Help Center.

1.2 Booking. When you book a Listing, you are agreeing to pay all charges for your booking including the Listing price, applicable fees like Hangout Dreamspot’s service fee, offline fees, taxes, and any other items identified during checkout (collectively, “Total Price”). If you choose to pay using a currency that differs from the currency set by the Host for their Listing, the price displayed to you is based on a currency conversion rate determined by us. You are also agreeing that Hangout Dreamspot  may charge the Payment Method (as defined in the Payment Terms) used to book the Listing in order to collect Damage Claim  amounts.

When you receive the booking confirmation, a contract for Host Services (a “Reservation”) is formed directly between you and the Host. By making a Reservation you are agreeing to the terms of the contract. The terms of the contract include these Terms, all terms of the Reservation, including without limitation, the cancellation

 Price and payment

  1. We want you to get the best possible price every time. If, after you’ve booked your Accommodation with us, you find the same Accommodation (with the same conditions) for less on another website, we promise to refund the difference, subject to the We Price Match terms and conditions.

Partner offer

  1. Some offers on our Platform are marked as “Partner offers,” which means they come to us through a Hangout Dreamspot partner company, rather than straight from a Service Provider. Unless otherwise indicated, any Partner offer that you reserve:

– Must be paid for at the time of booking

– Can’t be modified. However, if it offers free cancellation, you’ll be able to cancel it for free, as long as you do so in time.

– Can’t be combined with any other offers (promotions, incentives, or rewards)

-Can’t be scored or reviewed on our Platform.

Price incentives by Hangout Dreamspot

  1. Some of the price reductions you see are funded by us, not by the Service Provider. We simply pay some of the cost ourselves.

  1. In some cases, you’ll find a button marked “Request to book” on the property page. If you select this option, we’ll explain how this works (on-screen and/or by email).

Damage policy

  1. When you’re booking, you may see that some Service Providers refer to a “damage policy.” This means that if anyone in your group loses or damages anything:

– you should inform the Service Provider

– instead of charging you for it directly, the Service Provider will have 14 days to submit a damage payment request through our Platform, under your reservation number

– if they do, we’ll tell you, then you can tell us if you have any comments and whether you agree with the charge – then:

-if you agree, we’ll charge you on their behalf

-if you disagree, we’ll look into it and decide whether or not to discuss it further.

  1. Under the damage policy, there’s a limit to how much a Service Provider can charge you through our Platform (the limit is displayed while you’re booking). However, the Service Provider can start a legal claim against you outside of the damage policy, in which case the limit doesn’t apply.
  2. Any payment you make would be between the Service Provider and you. We’d just be organizing it on the Service Provider’s behalf.
  3. The damage policy doesn’t relate to general cleaning, ordinary wear and tear, any crimes (such as theft), or any non-physical “damages” (e.g. fines for smoking or bringing pets).
  4. The Service Provider might require a “damage deposit” before or at check-in. If they do, we’ll tell you about it while you’re booking—but it has nothing to do with the “damage policy.” We won’t be involved in any financial settlement related to damage deposits.

We abide to the policy and any other rules, standards, policies, or requirements identified in the Listing or during checkout that apply to the Reservation. It is your responsibility to read and understand these terms of the contract including these Terms and all terms of the Reservation including all rules, standards, policies, and requirements prior to booking a Listing. Be aware that some Hosts work with a co-host or as part of a team to provide their Host Services.

1.3 Accommodation Reservations. An Accommodation Reservation is a limited license to enter, occupy, and use the Accommodation. The Host retains the right to re-enter the Accommodation during your stay, to the extent: (i) it is reasonably necessary, (ii) permitted by your contract with the Host, and (iii) permitted by applicable law. If you stay past checkout, the Host has the right to make you leave in a manner permitted with applicable law, including by imposing reasonable overstay penalties. You may not exceed the maximum number of allowed Guests.

1.4 Reservations for Experiences and Other Host Services. An Experience or other Host Service Reservation entitles you to participate in, attend, or use that Host Service. You are responsible for confirming that you, and anyone you invite, meet minimum age, proficiency, fitness, or other requirements. You are responsible for informing the Host of any medical or physical conditions, or other circumstances that may impact your ability to participate, attend, or use the Experience or Host Service. Except where expressly authorized, you may not allow any person to join an Experience or Host Service unless they are included as an additional guest during the booking process.

  1. Cancellations, Reservation Issues, Refunds and Booking Modifications.

2.1 Cancellations, Reservation Issues, and Refunds. In general, if you cancel a Reservation, the amount refunded to you is determined by the Host’s cancellation policy that applies to that Reservation. But, in certain situations, other policies take precedence and determine what amount is refunded to you. If something outside your control forces you to cancel a Reservation, you may be eligible for a partial or full refund under our Extenuating Circumstances Policy. If the Host cancels, or you experience a Reservation Issue (as defined in our Rebooking and Refund Policy), you may be eligible for rebooking assistance or a partial or full refund under the Rebooking and Refund Policy. Different policies apply to certain categories of Listings; for example Experiences Reservations are governed by the Experiences Guest Refund Policy. See each Additional Legal Term or Policy for details about what is covered, and what refund applies in each situation.  You may appeal a decision by Hangout Dreamspot by contacting our customer service.

2.2 Booking Modifications. Guests and Hosts are responsible for any booking modifications they agree to make via the Hangout Dreamspot Platform or direct Hangout Dreamspot customer service to make on their behalf (“Booking Modifications”), and agree to pay any additional amounts, fees, or taxes associated with any Booking Modification.

  1. Your Responsibilities and Assumption of Risk.

3.1 Your Responsibilities. You are responsible and liable for your own acts and omissions and are also responsible for the acts and omissions of anyone you invite to join or provide access to any Accommodation, all areas and facilities where the Accommodation is located that the Host and Guest are legally entitled to use in connection with the Accommodation (“Common Areas”), or any Experience or other Host Service. For example, this means: (i) you are responsible for leaving an Accommodation (and related personal property) or Common Areas in the condition it was in when you arrived, (ii) you are responsible for paying all reasonable Damage Claim amounts, and (iii) you must act with integrity, treat others with respect, and comply with applicable laws at all times. If you are booking for an additional guest who is a minor or if you bring a minor to a Host Service, you must be legally authorized to act on behalf of the minor and you are solely responsible for the supervision of that minor.

3.2 Your Assumption of Risk. You acknowledge that many activities carry inherent risks and agree that, to the maximum extent permitted by applicable law, you assume the entire risk arising out of your access to and use of the Hangout Dreamspot Platform and any Content (as defined in Section 9), including your stay at any Accommodation, participation in any Experience, use of any other Host Service, or any other interaction you have with other Members whether in person or online. This means it is your responsibility to investigate a Host Service to determine whether it is suitable for you. Host Services may carry risk of illness, bodily injury, disability, or death, and you freely and willfully assume those risks by choosing to participate in those Host Services.

 

 

Host Terms

  1. Hosting on Hangout Dreamspot

4.1 Host. As a Host, Hangout Dreamspot offers you the right to use the Hangout Dreamspot Platform in accordance with these Terms to share your Accommodation, Experience, or other Host Service with our vibrant community of Guests – and earn money doing it. It’s easy to create a Listing and you are in control of how you host – set your price, availability, and rules for each Listing.

4.2 Contracting with Guests. When you accept a booking request, or receive a booking confirmation through the Hangout Dreamspot Platform, you are entering into a contract directly with the Guest, and are responsible for delivering the Host Service under the terms and at the price specified in your Listing. You are also agreeing to pay applicable fees like Hangout Dreamspot’s service fee (and applicable taxes) for each booking. Hangout Dreamspot will deduct amounts you owe from your payout unless we and you agree to a different method. Any terms or conditions that you include in any supplemental contract with Guests must: (i) be consistent with these Terms, our Additional Legal Terms, Policies, and the information provided in your Listing, and (ii) be prominently disclosed in your Listing description.

4.3 Independence of Hosts. Your relationship with Hangout Dreamspot is that of an independent individual or entity and not an employee, agent, joint venturer, or partner of Hangout Dreamspot, except that Hangout Dreamspot acts as a payment collection agent as described in the Payments Terms. Hangout Dreamspot does not direct or control your Host Service, and you understand that you have complete discretion whether and when to provide Host Services, and at what price and on what terms to offer them.

  1. Managing Your Listing.

5.1 Creating and Managing Your Listing. The Hangout Dreamspot Platform provides tools that make it easy for you to set up and manage a Listing. Your Listing must include complete and accurate information about your Host Service, your price, other charges like cleaning fees, resort fees, offline fees, and any rules or requirements that apply to your Guests or Listing. You are responsible for your acts or omissions as well as keeping your Listing information (including calendar availability) and content (like photos) up-to-date and accurate at all times. You are responsible for obtaining appropriate insurance for your Host Services and we suggest you carefully review policy terms and conditions including coverage details and exclusions. You may only maintain one Listing per Accommodation, but may have multiple Listings for a single property if it has multiple places to stay. Any offer of an Experience is subject to our Additional Terms for Experience Hosts.

5.2 Know Your Legal Obligations. You are responsible for understanding and complying with any laws, rules, regulations, and contracts with third parties that apply to your Listing or Host Services. For example: Some landlords and leases, or homeowner and condominium association rules, restrict or prohibit subletting, short-term rentals and/or longer-term stays. Some cities have zoning or other laws that restrict the short-term rental of residential properties. Some jurisdictions require Hosts to register, get a permit, or obtain a license before providing certain Host Services (such as short-term rentals, longer-term stays, preparing food, serving alcohol for sale, guiding tours, or operating a vehicle). In some places, the Host Services you want to offer may be prohibited altogether. Some jurisdictions require that you register Guests who stay at your Accommodation. Some jurisdictions have laws that create tenancy rights for Guests and additional obligations for Hosts. For example, some places have landlord-tenant, rent control, and eviction laws that may apply to longer stays. Check your local rules to learn what rules apply to the Host Services you plan to offer. Information we provide regarding legal requirements is for informational purposes only and you should independently confirm your obligations. You are responsible for handling and using personal data of Guests and others in compliance with applicable privacy laws and these Terms, including our Host Privacy Standards. If you have questions about how local laws apply you should always seek legal advice.

5.3 Search Results. The ranking of Listings in search results on the Hangout Dreamspot Platform depends on a variety of factors, including these main parameters:

– Guest search parameters (e.g. number of Guests, destination, time and duration of the trip, price range),

-Listing characteristics (e.g. price, calendar availability, number and quality of images, Reviews, type of Host Service, Host status, length of time the Listing has been live on the Hangout Dreamspot Platform, Guest engagement and popularity),

-Guest experience (e.g. customer service and cancellation history of the Host, ease of booking),

Host and Listing requirements (e.g. minimum

(e.g. minimum or maximum nights, booking cut-off time), and

Guest preferences and history (e.g. previous trips, viewed and saved Listings, location from where the Guest is searching).

 Hangout Dreamspot may allow Hosts to promote their Listings in search or elsewhere on the Hangout Dreamspot Platform by paying an additional fee.

5.4 Your Responsibilities. You are responsible and liable for your own acts and omissions and are also responsible for the acts and omissions of anyone you allow to participate in providing your Host Services. You are responsible for setting your price and establishing rules and requirements for your Listing. You must describe any and all fees and charges in your Listing description and may not collect any additional fees or charges outside the Hangout Dreamspot Platform except those expressly authorized by our Offline Fee Policy. Do not encourage Guests to create third-party accounts, submit reviews, provide their contact information, or take other actions outside the Hangout Dreamspot Platform in violation of our Off-Platform Policy.

5.5 Hosting as a Team or Organization. If you work with a co-host or host as part of a team, business, or other organization, you are responsible and liable as a Host under these Terms for the acts and omissions of each entity and individual who participates in providing your Host Services and you are responsible for informing personnel engaged by you to deliver any Host Services of your obligations under these Terms. If you accept terms or enter into contracts with third parties, you represent and warrant that you are authorized to enter into contracts for and bind your team, business or other organization, and that each entity you use is in good standing under the laws of the place where it is established. If you perform other functions, you represent and warrant that you are authorized to perform those functions. If you instruct Hangout Dreamspot to transfer a portion of your payout to a co-host or other Hosts, or send payments to someone else, you must be authorized to do so, and are responsible and liable for the payment amounts and accuracy of any payout information you provide.

5.6 Your Assumption of Risk. You acknowledge that hosting carries inherent risks and agree that you assume the entire risk arising out of your access to and use of the Hangout Dreamspot Platform, offering Host Services, or any interaction you have with other Members whether in person or online. You agree that you have had the opportunity to investigate the Hangout Dreamspot Platform and any laws, rules, regulations, or obligations that may be applicable to your Listings or Host Services and that you are not relying upon any statement of law made by Hangout Dreamspot.

  1. Cancellations, Reservation Issues, and Booking Modifications.

6.1 Cancellations and Reservation Issues. In general, if a Guest cancels a Reservation, the amount paid to you is determined by the cancellation policy that applies to that Reservation. As a host, you should not cancel on a Guest without a valid reason under our Extenuating Circumstances Policy or applicable law. If you cancel on a Guest without such a valid reason, we may impose a cancellation fee and other consequences. If: (i) a Guest experiences a Reservation Issue (as defined by the Re-booking and Refund Policy), (ii) an Extenuating Circumstance arises, or (iii) a Reservation is canceled under these Terms, the amount you are paid will be reduced by the amount we refund or otherwise provide to the Guest, and by any other reasonable costs we incur as a result of the cancellation. If a Guest receives a refund after you have already been paid, or the amount of the refund and other costs incurred by Hangout Dreamspot exceeds your payout, Hangout Dreamspot may recover that amount from you, including by deducting the refund against your future payouts. You agree that Hangout Dreamspot’s Re-booking and Refund Policy, Extenuating Circumstances Policy, and these Terms preempt the cancellation policy you set in situations where they allow for the cancellation of a Reservation and/or the issuance of refunds to Guests. If we reasonably expect to provide a refund to a Guest under one of these policies, we may delay release of any payout for that Reservation until a refund decision is made. If you Host an Experience please note that the Experience Cancellation Policy, Experiences Guest Refund Policy and different cancellation fees and consequences apply to your Reservations. See each Policy for details about what is covered, and what your payout will be in each situation.

6.2 Booking Modifications. Hosts and Guests are responsible for any Booking Modifications they agree to make via the Hangout Dreamspot Platform or direct Hangout Dreamspot customer service to make on their behalf, and agree to pay any additional amounts, fees or taxes associated with a Booking Modification.

 

  1. Taxes.

7.1 Host Taxes. As a Host, you are responsible for determining and fulfilling your obligations under applicable laws to report, collect, remit, or include in your price any applicable VAT or other indirect taxes, occupancy taxes, tourist, income, or other taxes (“Taxes”).

7.2 Collection and Remittance by Hangout Dreamspot. In jurisdictions where Hangout Dreamspot facilitates the collection and/or remittance of Taxes on behalf of Hosts, you instruct and authorize Hangout Dreamspot to collect Taxes on your behalf, and/or to remit such Taxes to the relevant Tax authority. Any Taxes that are collected and/or remitted by Hangout Dreamspot are identified to Members on their transaction records, as applicable. Hangout Dreamspot.Hangout Dreamspot may seek additional amounts from Members (including by deducting such amounts from future payouts) when the Taxes collected and/or remitted are insufficient to fully discharge that Members’ tax obligations, and you agree that your sole remedy for Taxes collected by Hangout Dreamspot is a refund from the applicable Tax authority. You acknowledge and agree that we retain the right, with prior notice to affected Members, to cease the collection and remittance of Taxes in any jurisdiction for any reason.

7.3 Tax Information. In certain jurisdictions, Tax regulations may require that we collect and/or report Tax information about you, or withhold Taxes from payouts to you, or both. If you fail to provide us with documentation that we determine to be sufficient to support any such obligation to withhold Taxes from payouts to you, we may withhold payouts up to the amount as required by law, until sufficient documentation is provided. You agree that Hangout Dreamspot may issue on your behalf invoices or similar documentation for VAT, GST, consumption or other Taxes for your Host Services to facilitate accurate tax reporting.

General Terms

  1. Reviews.

After each Host Service, Guests and Hosts will have an opportunity to review each other. Your Review must be accurate and may not contain any discriminatory, offensive, defamatory, or other language that violates these Terms, applicable law, or our Content Policy or Review Policy. Reviews are not verified by Hangout Dreamspot for accuracy and may be incorrect or misleading.

  1. Content.

Parts of the Hangout Dreamspot Platform enable you to provide feedback, text, photos, information, and other content (“Content”). By providing Content, in whatever form and through whatever means, you grant Hangout Dreamspot a non-exclusive, worldwide, royalty-free, perpetual, sub-licencable and transferable license to access, use, store, copy, modify, prepare derivative works of, distribute, publish, transmit, stream, broadcast, and otherwise exploit, in any manner such that Content to provide and/or promote the Hangout Dreamspot Platform, in any media or platform, known or unknown to date and in particular on Internet and social networks. If Content includes personal information, such Content will only be used for these purposes if such use complies with applicable data protection laws in accordance with our Privacy Policy. Where Hangout Dreamspot pays for the creation of Content or facilitates its creation, Hangout Dreamspot may own that Content, in which case supplemental terms or disclosures will say that. You are solely responsible for all Content that you provide and warrant that you either own it or are authorized to grant Hangout Dreamspot the rights described in these Terms. You are responsible and liable if any of your Content violates or infringes the intellectual property or privacy rights of any third party. Content must comply with our Content Policy and Nondiscrimination Policy, which prohibit, among other things, discriminatory, obscene, harassing, deceptive, violent, and illegal content. You agree that Hangout Dreamspot may make available services or automated tools to translate Content and that your Content may be translated using such services or tools. Hangout Dreamspot does not guarantee the accuracy or quality of translations and Members are responsible for confirming the accuracy of such translations.

  1. Fees.

Hangout Dreamspot may charge fees (and applicable Taxes) to Hosts and Guests for the right to use the Hangout Dreamspot Platform. More information about when service fees apply and how they are calculated can be found on our Service Fees page. Any applicable fees are disclosed to Guests before making a Booking. Except as otherwise provided on the Hangout Dreamspot Platform, service fees are non-refundable. Hangout Dreamspot reserves the right to change the service fees at any time, and will provide Members notice of any fee changes before they become effective. Fee changes will not affect bookings made prior to the effective date of the fee change. If you disagree with a fee change you may terminate this agreement at any time.

  1. Hangout Dreamspot Platform Rules.

11.1 Rules. You must follow these rules and must not help or induce others to break or circumvent these rules.

– Act with integrity and treat others with respect

-Do not lie, misrepresent something or someone, or pretend to be someone else.

-Be polite and be respectful when you communicate or interact with others.

-Do not attempt to evade enforcement of these Terms, our Additional Legal Terms, Policies, or our Standards, such as by creating a duplicate account or listings.

-Follow our Nondiscrimination Policy and do not discriminate against or harass others.

– Do not scrape, hack, reverse engineer, compromise or impair the Hangout Dreamspot Platform

– Do not use bots, crawlers, scrapers, or other automated means to access or collect data or other content from or otherwise interact with the Hangout Dreamspot Platform.

– Do not hack, avoid, remove, impair, or otherwise attempt to circumvent any security or technological measure used to protect the Hangout Dreamspot Platform or Content.

– Do not decipher, decompile, disassemble, or reverse engineer any of the software or hardware used to provide the Hangout Dreamspot Platform.

– Do not take any action that could damage or adversely affect the performance or proper functioning of the Hangout Dreamspot Platform.

– Only use the Hangout Dreamspot Platform as authorized by these Terms or another agreement with us

– You may only use another Member’s personal information as necessary to facilitate a transaction using the Hangout Dreamspot Platform as authorized by these Terms.

– Do not use the Hangout Dreamspot Platform, our messaging tools, or Members’ personal information to send commercial messages without their express consent.

– You may use Content made available through the Hangout Dreamspot Platform solely as necessary to enable your use of the Hangout Dreamspot Platform as a Guest or Host.

– Do not use Content unless you have permission from the Content owner or the use is authorized by us in these Terms or another agreement you have with us.

– Do not request, make, or accept a booking or any payment outside of the Hangout Dreamspot Platform to avoid paying fees, taxes or for any other reason. See our Offline Fee Policy for exceptions.

– Do not require or encourage Guests to open an account, leave a review, complete a survey, or otherwise interact, with a third party website, or service before, during or after a Reservation, unless authorized by Hangout Dreamspot.

– Do not engage in any practices that are intended to manipulate our search algorithm.

– Do not book Host Services unless you are actually using the Host Services.

– Do not use, copy, display, mirror or frame the Hangout Dreamspot Platform, any Content, any Hangout Dreamspot branding, or any page layout or design without our consent.

– Honor your legal obligations

– Understand and follow the laws that apply to you, including privacy, data protection, and export laws.

– If you provide us with someone else’s personal information, you: (i) must do so in compliance with applicable law, (ii) must be authorized to do so, and (iii) authorize us to process that information under our Privacy Policy.

Read and follow our Terms, Additional Legal Terms, Policies, and Standards.

Do not organize or facilitate unauthorized parties or events. You are responsible and liable for any party or event during your Reservation that violates our rules for parties and events, as incorporated by reference herein.

Do not use the name, logo, branding, or trademarks of Hangout Dreamspot or others without permission, and only as set forth in our Trademark Guidelines.

Do not use or register any domain name, social media handle, trade name, trademark, branding, logo, or other source identifier that is confusingly similar to any Hangout Dreamspot trademarks, logos or branding. See our Trademark Guidelines for additional details.

Do not offer Host Services that violate the laws or agreements that apply to you.

Do not offer or solicit prostitution or participate in or facilitate human trafficking.

11.2 Reporting Violations. If you believe that a Member, Listing or Content poses an imminent risk of harm to a person or property, you should immediately contact local authorities before contacting Hangout Dreamspot. In addition, if you believe that a Member, Listing or Content has violated our Standards, you should report your concerns to Hangout Dreamspot. If you reported an issue to local authorities, Hangout Dreamspot may request a copy of that report. Except as required by law, we are not obligated to take action in response to any report.

11.3 Copyright Notifications. If you believe that Content on the Hangout Dreamspot Platform infringes copyrights, please notify us in accordance with our Copyright Policy.

  1. Termination, Suspension and other Measures.

12.1 Term. The agreement between you and Hangout Dreamspot Platform reflected by these Terms is effective when you access the Hangout Dreamspot Platform (for example to create an account) and remains in effect until either you or we terminate the agreement in accordance with these Terms.

12.2 Termination. You may terminate this agreement at any time by sending us an email or by deleting your account. Hangout Dreamspot may terminate this agreement and your account for any reason by providing you 30 days’ notice via email or using any other contact information you have provided for your account. Hangout Dreamspot may also terminate this agreement immediately and without notice and stop providing access to the Hangout Dreamspot Platform if you breach these Terms, you violate our Additional Legal Terms, or Policies, you violate applicable laws, or we reasonably believe termination is necessary to protect Hangout Dreamspot, its Members, or third parties. If your account has been inactive for more than two years, we may terminate your account without prior notice.

– suspend or limit your access to or use of the Hangout Dreamspot Platform and/or your account;

– suspend, remove, disable access to, or restrict visibility of Listings, Reviews, or other Content;

cancel pending or confirmed bookings; or

– suspend or revoke any special status associated with your account.

For minor violations or where otherwise appropriate as Hangout Dreamspot determines in its sole discretion, you will be given notice of any intended measure by Hangout Dreamspot and an opportunity to resolve the issue. You may appeal actions taken by us under this Section by contacting customer service. If a Reservation is canceled under this Section, the amount paid to the Host will be reduced by the amount we refund or otherwise provide to the Guest, and by any other costs we incur as a result of the cancellation.

12.4 Legal Mandates. Hangout Dreamspot may take any action it determines is reasonably necessary to comply with applicable law, or the order or request of a court, law enforcement, or other administrative agency or governmental body, including the measures described above in Section 12.3.

12.5 Effect of Termination. If you are a Host and terminate your Hangout Dreamspot account, any confirmed booking(s) will be automatically canceled and your Guests will receive a full refund. If you terminate your account as a Guest, any confirmed booking(s) will be automatically canceled and any refund will depend upon the terms of the Reservation’s cancellation policy. When this agreement has been terminated, you are not entitled to a restoration of your account or any of your Content. If your access to or use of the Hangout Dreamspot Platform has been limited, or your Hangout Dreamspot account has been suspended, or this agreement has been terminated by us, you may not register a new account or access or use the Hangout Dreamspot Platform through an account of another Member.

12.6 Survival. Parts of these Terms that by their nature survive termination, will survive termination of this agreement.

  1. Modification.

Hangout Dreamspot may modify these Terms at any time. When we make material changes to these Terms, we will post the revised Terms on the Hangout Dreamspot Platform and update the “Last Updated” date at the top of these Terms. We will also provide you with notice of any material changes by email, notifications through the Hangout Dreamspot Platform, messaging service, or any other contact method made available by us and selected by you at least 30 days before the date they become effective. If you disagree with the revised Terms, you may terminate this agreement immediately as provided in these Terms. If you do not terminate your agreement before the date the revised Terms become effective, your continued access to or use of the Hangout Dreamspot Platform will constitute acceptance of the revised Terms.

  1. Resolving Complaints and Damage Claims.

If a Member provides valid evidence that you, your guest(s), or your pet(s) have:

(i) damaged the complaining Member’s, or the Accommodation owner’s (where the Accommodation owner is not also the Host), real or personal property, or real or personal property the complaining Member is responsible for, or has an economic interest in; or

(ii) caused loss of booking income for bookings via the Hangout Dreamspot Platform or other consequential damages which result directly from the damage caused under (i) above; or

(iii) otherwise caused the complaining Member to incur cleaning costs in excess of the Member’s cleaning fee (each of (i), (ii), and (iii) being a (“Damage Claim”),

– the complaining Member can notify Hangout Dreamspot and. You will be notified of the Damage Claim and given an opportunity to respond. If you agree to pay, or if the Damage Claim is escalated to Hangout Dreamspot and Hangout Dreamspot determines in its sole discretion that the Damage Claim is valid and you are responsible for the Damage Claim, Hangout Dreamspot  can collect the amount of the Damage Claim from you. You agree that Hangout Dreamspot may seek to recover from you under any insurance policies you maintain and that Hangout Dreamspot may also pursue against you any remedies it may have available under applicable law, including referral of the matter to a collections agency, and/or pursuit of available causes of action and/or claims against you. You agree to cooperate in good faith, provide any information Hangout Dreamspot requests, execute documents, and take further reasonable action, in connection with Damage Claims, Member complaints, claims under insurance policies, or other claims related to your provision or use of Host Services.

  1. Hangout Dreamspot Roles.

We offer you the right to use a platform that enables Members to publish, offer, search for, and book Host Services. While we work hard to ensure our Members have great experiences using Hangout Dreamspot, we do not and cannot control the conduct of Guests and Hosts. You acknowledge that Hangout Dreamspot has the right, but does not have any obligation, to monitor the use of the Hangout Dreamspot Platform and verify information provided by our Members. For example, we may review, disable access to, remove, or edit Content to: (i) operate, secure and improve the Hangout Dreamspot Platform (including for fraud prevention, risk assessment, investigation and customer support purposes); (ii) ensure Members’ compliance with these Terms; (iii) comply with applicable law or the order or requirement of a court, law enforcement or other administrative agency or governmental body; (iv) address Content that we determine is harmful or objectionable; (v) take actions set out in these Terms; and (vi) maintain and enforce any quality or eligibility criteria, including by removing Listings that don’t meet quality and eligibility criteria. Members acknowledge and agree that Hangout Dreamspot administers its Additional Legal Terms, Policies such as basic requirements for hosts, including decisions about whether and how to apply them to a particular situation, at its sole discretion. Members agree to cooperate with and assist Hangout Dreamspot in good faith, and to provide Hangout Dreamspot with such information and take such actions as may be reasonably requested by Hangout Dreamspot with respect to any investigation undertaken by Hangout Dreamspot regarding the use or abuse of the Hangout Dreamspot Platform. Hangout Dreamspot is not acting as an agent for any Member except for where Hangout Dreamspot as a collection agent as provided in the  Terms.

  1. Member Accounts.

You must register an account to access and use many features of the Hangout Dreamspot Platform. Registration is only permitted for legal entities, partnerships and natural persons who are 18 years or older. You represent and warrant that you are not a person or entity barred from using the Hangout Dreamspot Platform under the laws of South Africa, your place of residence, or any other applicable jurisdiction. You must provide accurate, current, and complete information during registration and keep your account information up-to-date. You may not transfer your account to someone else. You are responsible for maintaining the confidentiality and security of your account credentials and may not disclose your credentials to any third party. You are responsible and liable for activities conducted through your account and must immediately notify Hangout Dreamspot if you suspect that your credentials have been lost, stolen, or your account is otherwise compromised. If and as permitted by applicable law, we may, but have no obligation to (i) ask you to provide identification or other information, (ii) undertake checks designed to help verify your identity or background, (iii) screen you against third-party databases or other sources and request reports from service providers, and (iv) obtain reports from public records of criminal convictions or sex offender registrations or their local equivalents.

  1. Disclaimer of Warranties.

We provide the Hangout Dreamspot Platform and all Content “as is” without warranty of any kind and we disclaim all warranties, whether express or implied. For example: (i) we do not endorse or warrant the existence, conduct, performance, safety, quality, legality or suitability of any Guest, Host, Host Service, Listing or third party; (ii) we do not warrant the performance or non-interruption of the Hangout Dreamspot Platform; and (iii) we do not warrant that verification, identity or background checks conducted on Listings or Members (if any) will identify past misconduct or prevent future misconduct. Any references to a Member or Listing being “verified” (or similar language) indicate only that the Member or Listing or Hangout Dreamspot has completed a relevant verification or identification process and nothing else. The disclaimers in these Terms apply to the maximum extent permitted by law. If you have statutory rights or warranties Hangout Dreamspot cannot disclaim, the duration of any such statutorily required rights or warranties, will be limited to the maximum extent permitted by law.

  1. Limitations on Liability.

Neither Hangout Dreamspot (including its affiliates and personnel) nor any other party involved in creating, producing, or delivering the Hangout Dreamspot Platform or any Content will be liable for any incidental, special, exemplary or consequential damages, including lost profits, loss of data or loss of goodwill, service interruption, computer damage or system failure or the cost of substitute products or services, or for any damages for personal or bodily injury or emotional distress arising out of or in connection with (i) these Terms, (ii) the use of or inability to use the Hangout Dreamspot Platform or any Content, (iii) any communications, interactions or meetings you may have with someone you interact or meet with through, or as a result of, your use of the Hangout Dreamspot Platform, or (iv) publishing or booking of a Listing, including the provision or use of Host Services, whether based on warranty, contract, tort (including negligence), product liability or any other legal theory, and whether or not Hangout Dreamspot has been informed of the possibility of such damage, even if a limited remedy set out in these Terms is found to have failed of its essential purpose.

Except for our obligation to transmit payments to Hosts under these Terms, or make payments under Hangout Dreamspot , in no event will Hangout Dreamspot aggregate liability for any claim or dispute arising out of or in connection with these Terms, your interaction with any Members, or your use of or inability to use the Hangout Dreamspot Platform, any Content, or any Host Service, exceed: (A) to Guests, the amount you paid as a Guest during the 12-month period prior to the event giving rise to the liability, (B) to Hosts, the amount paid to you as a Host in the 12-month period prior to the event giving rise to the liability.

These limitations of liability and damages are fundamental elements of the agreement between you and Hangout Dreamspot. If applicable law does not allow the limitations of liability set out in these Terms, the above limitations may not apply to you.

  1. Indemnification.

To the maximum extent permitted by applicable law, you agree to release, defend (at Hangout Dreamspot options), indemnify, and hold Hangout Dreamspot (including other affiliates, and their personnel) harmless from and against any claims, liabilities, damages, losses, and expenses, including, without limitation, reasonable legal and accounting fees, arising out of or in any way connected with: (i) your breach of these Terms (including any supplemental or additional terms that apply to a product or feature) or our Additional Legal Terms,  Policies or Standards, (ii) your improper use of the Hangout Dreamspot Platform, (iii) your interaction with any Member, stay at an Accommodation, participation in an Experience or other Host Service, including without limitation any injuries, losses or damages (whether compensatory, direct, incidental, consequential or otherwise) of any kind arising in connection with or as a result of such interaction, stay, participation or use, (iv) your failure, or our failure at your direction, to accurately report, collect or remit Taxes, or (v) your breach of any laws, regulations or third party rights such as intellectual property or privacy right

  1. Contracting Entities.

Based on your country of residence or establishment and what you are doing on the Hangout Dreamspot Platform, Schedule 1 below sets out the Hangout Dreamspot entity with whom you are contracting. If we identify through the Hangout Dreamspot Platform, an Hangout Dreamspot entity other than the one set out on Schedule 1 as being responsible for a product, feature or transaction, the Hangout Dreamspot entity so identified is your contracting entity with respect to that product, feature or transaction. If you change your country of residence or establishment, the Hangout Dreamspot company you contract with (as set out on Schedule 1) and the applicable version of the Terms of Service will be determined by your new country of residence or establishment, from the date on which your country of residence or establishment changes.

21.South Africa Governing Law and Venue

If you reside or have your place of establishment in South Africa, the Terms will be interpreted in accordance with the laws of South Africa, without regard to conflict-of-law provisions. Judicial proceedings (other than small claims actions) that are excluded from the arbitration agreement must be brought in state or court in South Africa, unless we both agree to some other location. You and we both consent to venue and personal jurisdiction in Cape Town,South Africa.

  1. South Africa Dispute Resolution and Arbitration Agreement.

PLEASE READ THE FOLLOWING PARAGRAPHS CAREFULLY BECAUSE THEY PROVIDE THAT YOU AND HANGOUT DREAMSPOT AGREE TO RESOLVE ALL DISPUTES BETWEEN US THROUGH BINDING INDIVIDUAL ARBITRATION AND INCLUDE A CLASS ACTION WAIVER AND JURY TRIAL WAIVER. This Arbitration Agreement supersedes all prior versions.

22.4 Agreement to Arbitrate. You and Hangout Dreamspot mutually agree that any dispute, claim or controversy arising out of or relating to these Terms or the applicability, breach, termination, validity, enforcement or interpretation thereof, or any use of the Hangout Dreamspot Platform, Host Services, or any Content (collectively, “Disputes”) will be settled by binding arbitration on an individual basis (the “Arbitration Agreement”). If there is a dispute about whether this Arbitration Agreement can be enforced or applies to a Dispute, you and Hangout Dreamspot agree that an arbitrator will decide that issue. For the avoidance of doubt, you and Hangout Dreamspot agree that any question regarding arbitrability and the formation, enforceability, validity, scope  including any dispute over compliance with the Pre-Dispute Notice requirement and a party’s responsibility to pay arbitration fees, shall be resolved exclusively by an arbitrator.

22.5 Exceptions to Arbitration Agreement. You and Hangout Dreamspot each agree that the following causes of action and/or claims for relief are exceptions to the Arbitration Agreement and will be brought in a judicial proceeding in a court of competent jurisdiction : (i) any claim or cause of action alleging actual or threatened infringement, misappropriation or violation of a party’s copyrights, trademarks, trade secrets, patents, or other intellectual property rights; (ii) any claim or cause of action seeking emergency injunctive relief based on exigent circumstances (e.g., imminent danger or commission of a crime, hacking, cuber-attack); or (iii) a request for the remedy of public injunctive relief; (iv) any claim or cause of action for vexatious litigation; or (v) any individual claim of sexual assault or sexual harassment arising from your use of the Hangout Dreamspot Platform or Host Services. You and Hangout Dreamspot agree that any request for the remedy of public injunctive relief will proceed after the arbitration of all arbitrable claims, remedies, or causes of action, and will be stayed pending the outcome of the arbitration pursuant to section 3 of the South African Arbitration Act.

22.11Jury Trial Waiver.You and Hangout Dreamspot acknowledge and agree that both parties are each waiving the right to a trial by jury as to all arbitrable Disputes

22.12 No Class Actions or Representative Proceedings. You and Hangout Dreamspot acknowledge and agree that, to the fullest extent permitted by law, we are each waiving the right to participate as a plaintiff or class member in any purported class action lawsuit, class-wide arbitration, private attorney general action, or any other representative or consolidated proceeding. Unless we agree in writing or as provided in this agreement, the arbitrator may not consolidate more than one party’s claims and may not otherwise preside over any form of any class or representative proceeding. If there is a final judicial determination that applicable law precludes enforcement of the waiver contained in this paragraph as to any claim, cause of action or requested remedy, then that claim, cause of action or requested remedy, and only that claim, cause of action or requested remedy, will be severed from this agreement to arbitrate and will be brought in a court of competent jurisdiction. In the event that a claim, cause of action or requested remedy is severed pursuant to this paragraph, then you and we agree that the claims, causes of action or requested remedies that are not subject to arbitration will be stayed until all arbitrable claims, causes of action and requested remedies are resolved by the arbitrator.

22.13 Mass Action Waiver. You and Hangout Dreamspot acknowledge and agree that the relative benefits and efficiencies of arbitration may be lost when 100 or more arbitration claims are filed within 180 days which (1) involve the same or similarly situated parties; (2) are based on the same or similar claims which arise from the same or substantially identical transactions, incidents, alleged violations or events requiring the determination of the same or substantially identical questions of law or fact; and (3) involve the same or coordinated counsel for the parties (“Mass Action”). Accordingly, you and Hangout Dreamspot agree to waive the right to have any Dispute administered, arbitrated, or resolved. In case of a dispute, the appointed arbitrator for the first matter instituted within a set of claims identified by either party shall decide whether those claims are part of a Mass Action. If no arbitrator has yet been appointed, an arbitrator shall be appointed solely to determine whether claims identified by either party are part of a Mass Action. Nothing in this provision prevents you or Hangout Dreamspot from participating in a mass settlement of claims.

22.16 Sever-ability.In the event that any portion of this Arbitration Agreement is deemed illegal or unenforceable, such provision will be severed and the remainder of the Arbitration Agreement will be given full force and effect.

22.17 Amendment to Agreement to Arbitrate. If Hangout Dreamspot amends this section after the date you last accepted these Terms (or accepted any subsequent changes to these Terms), you may reject the change by sending us written notice no later than 30 days of the date the change is effective. Your notice must include your name, mailing address, the date of the notice, your Hangout Dreamspot username, the email address you used to set up your Hangout Dreamspot account.

  1. Rest of World Dispute Resolution, Venue and Forum, and Governing Law.

If you reside or have your place of establishment outside of the South Africa this Section applies to you and these Terms will be interpreted in accordance the laws of your jurisdiction. If you are acting as an individual consumer and if mandatory statutory consumer protection regulations in your country of residence contain provisions that are more beneficial for you, such provisions shall apply irrespective of the choice of your Jurisdiction laws. As an individual consumer, you may bring any judicial proceedings relating to these Terms before the competent court of your place of residence or the competent court of Hangout Dreamspot’s place of business. If Hangout Dreamspot wishes to enforce any of its rights against you as a consumer, we may do so only in the courts of the jurisdiction in which you are a resident. If you are acting as a business, you agree to submit to the exclusive jurisdiction of the courts.

26.3 No Waiver. Hangout Dreamspot’s failure to enforce any right or provision in these Terms will not constitute a waiver of such right or provision unless acknowledged and agreed to by us in writing. Except as expressly set forth in these Terms, the exercise by either party of any of its remedies under these Terms will be without prejudice to its other remedies under these Terms or otherwise permitted under law.

26.4 Assignment. You may not assign, transfer or delegate this agreement or your rights and obligations here-under without Hangout Dreamspot’s prior written consent. Hangout Dreamspot may without restriction assign, transfer or delegate this agreement and any rights and obligations here-under, at its sole discretion, with 30 days’ prior notice.

26.5 Notice. Unless specified otherwise, any notices or other communications to Members permitted or required under this agreement, will be provided electronically and given by Hangout Dreamspot via email, Hangout Dreamspot Platform notification, messaging service (including SMS), or any other contact method we enable and you provide.

26.6 Third-Party Services. The Hangout Dreamspot Platform may contain links to third-party websites, applications, services or resources (“Third-Party Services”) that are subject to different terms and privacy practices. Hangout Dreamspot is not responsible or liable for any aspect of such Third-Party Services and links to such Third-Party Services are not an endorsement.

26.7 Google Terms. Some translations on the Hangout Dreamspot Platform are powered by Google. Google disclaims all warranties related to the translations, express or implied, including any warranties of accuracy, reliability, and any implied warranties for merchant-ability, fitness for a particular purpose and non-infringement. Some areas of the Hangout Dreamspot Platform implement Google Maps/Earth mapping services, including Google Maps API(s). Your use of Google Maps/Earth is subject to the Google Maps/Google Earth Additional Terms of Service.

26.8 Platform Content.

 Content made available through the Hangout Dreamspot Platform, including without limitation trademarks, trade dress, inventions, algorithms, computer programs (in source code and object code), customer and marketing information and other content (“Platform Content”), whether registered or unregistered, which may be protected by copyright, trademark, patent, trade secrets, know how, and/or other laws of South Africa and other countries. You acknowledge that all intellectual property rights for that Platform Content are the exclusive property of Hangout Dreamspot and/or its licensors and agree that you will not remove, alter or obscure any copyright, trademark, service mark or other proprietary rights notices. You may not use, copy, adapt, modify, prepare derivative works of, distribute, license, sell, transfer, publicly display, publicly perform, transmit, broadcast or otherwise exploit any Platform Content accessed through the Hangout Platform except to the extent you are the legal owner of that Platform Content or as expressly permitted in these Terms. Subject to your compliance with these Terms, Hangout Dreamspot grants you a limited, non-exclusive, non-sublicensable, revocable, non-transferable license to (i) download and use the Application on your personal device(s); and (ii) access and view the Platform Content made available on or through the Hangout Dreamspot Platform and accessible to you, solely for your personal and non-commercial use.

26.10  Force Majeure. Hangout Dreamspot shall not be liable for any delay or failure to perform resulting from abnormal or unforeseeable circumstances outside its reasonable control, the consequences of which would have been unavoidable despite all efforts to the contrary, including, but not limited to, acts of God, natural disasters, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, pandemics, epidemics or disease, strikes or shortages of transportation facilities, fuel, energy, labor or materials.

26.12 Emails and SMS. You will receive administrative communications from us using the email address or other contact information you provide for your Hangout Dreamspot account. Enrollment in additional email subscription programs will not affect the frequency of these administrative emails, though you should expect to receive additional emails specific to the program(s) to which you have subscribed. You may also receive promotional emails from us. No fee is charged for these promotional emails, but third-party data rates could apply. You can control whether you receive promotional emails using the notification preferences in your account settings. Please note that you will not be able to take advantage of certain promotions if you disable certain communication settings or do not have a Hangout Dreamspot account. In South Africa if you consent to receive SMS (text messages) from us, you will be subject to our SMS Terms.

D1. Scope of this section

  1. This section contains the specific terms for Car Rental products and services. It applies as well as section A (which applies to all Travel Experiences).

D2. Contractual relationship

  1. The car rental pages on this Platform are operated by Hangout Dreamspot.This means that you accept that the process of making a Booking with Hangout Dreamspot is governed by these Terms—although your actual Rental will be governed by the Rental Agreement with your Service Provider (which you sign at pick-up).
  2. When you book a Rental, your Booking is either (a) with us or (b) directly with the Service Provider. Either way:

– our Terms govern the booking process. When we send you your Booking Confirmation, you’ll enter a contract with us

– the Rental Agreement governs the Rental itself. When you sign this at the rental counter, you’ll enter a contract with the Service Provider, but you’ll see and accept the key terms of it while you’re booking your car.

  1. In most cases, you’ll get your Booking Confirmation as soon as you complete your Booking. However, if the Service Provider doesn’t confirm your Rental immediately, we won’t take payment or send you your Booking Confirmation until they’ve done so.
  2. If there’s any discrepancy between these Terms and the Rental Agreement, the Rental Agreement will apply.
  3. The Main Driver (the person whose details are entered during the booking process) is the only person who can change or cancel the Booking, or discuss it with us—unless they tell us they nominate someone else to do this.

D3. What we will do

  1. We provide the Platform on which Service Providers can promote and sell their Travel Experiences, and you can search for, compare, and book them.
  2. We don’t guarantee the precise make and model you’re booking (unless we expressly say so). The phrase “or similar” means you could get a similar car (i.e. the same size, type of transmission, etc.). The car pictures are illustrative only.
  3. Once you’ve booked your Rental:

– we’ll give the Service Provider the Booking details (e.g. the Main Driver’s name and phone number)

– we’ll confirm the Pick-up information (e.g. the Service Provider’s contact details and what you need to take with you).

D4. What you need to do

  1. You must provide all the information we need to arrange your Booking (contact details, Pick-up Time, etc.).
  2. You must read and agree to comply with these Terms and the Rental Agreement, and acknowledge that if you breach them:

– you might have to pay additional charges

– your Booking might be canceled

– the staff might refuse to hand over the keys at the rental counter.

  1. You must check your Rental’s specific requirements, as many details (e.g. driver’s license requirements, security deposit size, paperwork needed, etc.) vary per Rental. Make sure you carefully read:

– the key terms of the Rental Agreement, which you’ll see while you’re booking, and

– the Rental Agreement itself, which you’ll receive at Pick-up.

  1. You must be at the rental counter by your Pick-up Time (note that some Service Providers have a pick-up “grace period” in case you are delayed). If you arrive after the Pick-up Time (and after the pick-up grace period, if any), the car may no longer be available, and you may not be entitled to a refund from the Service Provider. Please check the Rental Agreement for further information (while you’re booking your car, please check “Important info,” which informs you of any grace period, and which you accept at check-out). If you think you might be late, contact the Service Provider or us, even if it’s because of a flight delay and you’ve provided your flight number.
  2. The key terms of your Rental tell you what the Main Driver needs at pick-up. You must ensure that when they get to the rental counter, they bring everything they need (e.g. driver’s license, required ID, and a credit card in their own name, with enough available funds to cover the security deposit).
  3. You must make sure the Main Driver is both eligible and fit to drive the car.
  4. You must show the counter staff each driver’s full, valid driver’s license, which they must have held for at least one year (or longer, in many cases).
  5. If any driver has endorsements/points on their license, let us know as soon as you are aware of this, as the Service Provider may not allow them to drive.
  6. You must ensure that every driver has their own International Driving Permit (if they need one) as well as their driver’s license. All drivers must carry their driver’s license (and International Driving Permit, if necessary) at all times.
  7. You must ensure that every child has an appropriate child seat if they need one.
  8. If anything goes wrong during your Rental (e.g. accident, breakdown, etc.), you must:

– contact the Service Provider

– not authorize any repairs without the Service Provider’s consent (unless the Rental Agreement allows this)

– keep all documentation (e.g. repair bills, police reports, etc.) to share with us/the Service Provider/an insurance company

D5. Price and payment

  1. Hangout Dreamspot will arrange the payment for your Booking.

Additional costs and fees

  1. In many cases, the Service Provider will charge a young driver fee for each driver under a certain age (e.g. 25). In some cases, they may charge a senior driver fee for each driver over a certain age (e.g. 65). When booking on our Platform, you must enter the Main Driver’s age, so we can show you details of any age-related fee(s), which you would pay at pick-up.
  2. In many cases, the Service Provider will charge a one-way fee if you drop the car off at a different location. If you intend to do this, you need to enter the drop-off location while booking, so we can tell you if it’s possible, and show you details of any one-way fee, which you would pay at Pick-up.
  3. In many cases, the Service Provider will charge a cross-border fee for taking the car to a different country/state/island. If you intend to do this, tell us and/or the Service Provider as soon as you can before pick-up.
  4. The price of your Rental is calculated based on 24-hour units, for example, a 25-hour rental will cost as much as a 48-hour rental.
  5. If after Pick-up you decide you want to keep the car longer, contact the Service Provider. They’ll tell you how much this would cost, and you’ll enter a new contract with them. If you drop the car off late without agreeing to this in advance, they may charge an additional fee as well. 

 

Extras

  1. In some cases, you’ll pay for any optional extras (e.g. child seats, GPS, winter tires, etc.) when you book your car, in which case you’re guaranteed to get them at pick-up.
  2. In other cases, you’ll simply request any extras when you book your car, in which case:

– you’ll pay for them at Pick-up, and

– the Service Provider doesn’t guarantee they’ll be available for you.

D6. Amendments, cancellations, and refunds

  1. We go above and beyond our legal obligations. Even though local laws don’t require us to offer specific cancellation rights, we guarantee that we will honor our refunds policy if you cancel your Booking.
  2. If you cancel:

MORE THAN 48 hours before your rental is due to start, you’ll receive a full refund.

3.LESS THAN 48 hours before or while you’re at the rental counter, we’ll refund what you paid minus the cost of 3 days of your rental. There won’t be any refund if your car was booked for 3 days or less.

AFTER your rental is due to start (or if you no-show), you’ll receive no refund.

  1. The counter staff may refuse you the car if (for example):

– You don’t arrive on time

– You are not eligible to rent the car

– You don’t have the documentation you need

– The main driver doesn’t have a credit card in their own name, with enough available funds for the car’s security deposit.

For more on your Service Provider’s rules, refer to the “Important Information” that’s available while booking—or the Rental Agreement that you sign at the counter.

– If they refuse you the car, call us straight away from the rental counter to cancel your Booking, and we’ll refund what you paid, minus the cost of three days of your Rental. If you don’t, the cancellation fee will be the full cost of your Rental—unless you can prove that the situation has cost us substantially less than that.

Amendments (changes to your Booking)

  1. You can make changes to your Booking anytime before you’re due to pick the car up.
  2. In most cases, the easiest way to do this is via our our website.
  3. There is no administration fee for changing your Booking, but any changes you make may affect the rental price. Sometimes the only way we can change a Booking is to cancel it and make another one, in which case we may charge you a cancellation fee on the rental company’s behalf.
  4. If changing your Booking would change the price or incur a cancellation fee, we will tell you in advance.

Changes made by us

  1. If we/the Service Provider need to change your Booking (e.g. if the Service Provider can’t provide the car), we’ll tell you as soon as we can. If you don’t accept that change, you’ll be entitled to cancel and claim a full refund (no matter how close the start of your Rental is) but we won’t have any additional liability for any direct or indirect costs you may incur (e.g. hotel room, taxis).

D7. What else do you need to know?

General

  1. In all cases, drivers must be at least a minimum age to rent or drive a car. In some cases, they must also be below a maximum age. The limit(s) can vary by Service Provider, location, and type of car.
  2. Only eligible drivers whose names appear on the Rental Agreement may drive the car.
  3. You must not take the car to a different country/state/island and/or drop it off at a different location without arranging this in advance.

Late pick-up and early drop-off

  1. If you pick your car up later or drop it off earlier than agreed in your Booking Confirmation, the Service Provider will not refund you for the “unused” time.

E1. Scope of this section

  1. This section contains the specific terms for Flights products and services. It applies as well as section A (which applies to all Travel Experiences).

E2. Contractual relationship

  1. Most Flights on our Platform are provided via a Third-Party Aggregator, which acts as an intermediary to the airline(s).
  2. When you make a Booking, it’s directly with the airline. We’re not a “contractual party” to your Booking. When booking, you enter into (i) an Inter-mediation Contract with the Third-Party Aggregator (for the ticket) and (ii) a Contract of Carriage with the airline (for the Flight itself).
  3. If you book any extras (e.g. additional baggage, insurance, etc.), you’ll enter into a direct contract with the Third-Party Aggregator or another company. We will not be involved in this contract.
  4. We act solely as the Platform and are not involved in the Third-Party Terms. We are not responsible for your ticket or any extras you may buy and (to the fullest extent permitted by law) have no liability to you in relation to your Booking.

 

 

 

 

 

E3. What we will do

  1. We provide the Platform on which Service Providers can promote and sell their Travel Experiences, and you can search for, compare, and book them.
  2. Once you’ve booked your Flight, your Booking details (e.g. the names of the traveler(s)) will be provided to the Service Provider.
  3. Depending on the Contract of Carriage, we may be able to help you change or cancel your Booking if you want to do so. Contact us using the Help Center (available 24 hours a day) if you need help with anything.

E4. What you need to do

  1. You must fill in all your contact details correctly, so we and/or the Service Provider can provide you with information about your Booking and, if necessary, contact you.
  2. You must read and agree to comply with our Terms and the Third-Party Terms (which will be displayed at check-out) and acknowledge that breaching them may lead to additional charges and/or the cancellation of your Booking.

E5. Price and payment

  1. When you book a Flight, your payment will be organized by us, by the Third-Party Aggregator (or a party specified by them), or by a third party such as an airline.

E6. Amendments, cancellations, and refunds

  1. You’ll find the cancellation policy in the Contract of Carriage between you and the airline. It’s available while you’re booking your Flight and when your Flight is confirmed (in your “Manage Booking”).
  2. There may be a fee for changing or canceling your Flight.
  3. Airlines reserve the right to reschedule or cancel flights in accordance with the airline’s terms and conditions, Contract of Carriage, or airline policies.
  4. Different tickets from the same airline may have different restrictions or include different services. Make sure you read the full details provided during the booking process.
  5. If you have any questions about changes, cancellations, or refunds, contact our Customer Service team.

 

 

 

E7. What else do you need to know?

Code share

  1. Some airlines have “code share” agreements with other airlines. So you may buy your ticket from one airline (your “ticketing carrier”) but fly in a plane that’s owned by another airline (your “operating carrier”). In most cases like this, you’ll check in with your operating carrier, but confirm this with your ticketing carrier ahead of time.
  2. While you’re booking your Flight, you’ll be informed if it’s a “code share” Flight.

Airline prohibited practices

  1. Most airlines don’t allow people to buy tickets that include flights they don’t intend to use—for example, a round-trip ticket if the person doesn’t intend to use the return flight. For more examples, just enter “point-beyond ticketing,” “hidden-city ticketing,” or “back-to-back ticketing” into a search engine.
  2. When you purchase a Flight, you agree not to do this. If you do this in breach of the airline’s terms (provided when you make your Booking), you will reimburse us for any difference between the cost of your actual journey and the cost of the full journey specified on your ticket(s) if the airline claims this from us.

Use of flight segments

  1. Most airlines require customers to use their flights in order. If you don’t take your first Flight, your airline may automatically cancel the rest of your itinerary.
  2. If your airline does allow you to “skip” any Flights in your itinerary, make sure you cancel the Flight(s) you don’t want, in line with the cancellation policy. You may not be entitled to a full refund (or any refund) for these unused Flights.

One-way tickets

  1. If you buy two one-way tickets rather than a single round-trip ticket:

– you’ll be making two separate Bookings, each with its own rules and policies

– any changes to one Flight will not affect the other, for example, if your initial Flight is canceled, you won’t be guaranteed a refund for your second Flight.

  1. If you’re traveling abroad, you may need to prove to the check-in and/or immigration staff that you have a return Flight (see “International travel” below for more on passports, visas, etc.).

Charges, taxes, and fees

  1. Your fare will include any taxes and fees charged by an airline or government (except entry/exit fees – see “Entry/Exit fees” below). You may be responsible for dealing with any retroactive change in the tax rate.

Service Fees

  1. Depending on which Flight you choose, you may be charged a service fee by us and/or the Third-Party Aggregator.
  • Our service fee (if any) is a fee for using our Platform so you can buy a ticket from a Third-Party Aggregator. This fee includes any applicable VAT, GST, or similar taxes.
  • The Third-Party Aggregator’s service fee (if any) is a fee for using them as an intermediary to the airline(s). This fee may include any applicable VAT, GST, or similar taxes.
  1. The price of your ticket will include any service fee(s).

Fees for Baggage and Other Extras

  1. Your airline may charge for checked baggage, excess/overweight baggage, priority boarding, allocated seating, on-board entertainment, food and drink, and/or airport check-in.
  2. If they do, the charge(s) will be on top of the price of your ticket (unless it’s expressly stated that your Flight includes the extra(s)).

International Travel

  1. It’s your responsibility to:
  • Carry a valid passport and/or visa if required.
  • Comply with any entry requirements.
  • Find out if you need a visa to pass through a country that isn’t your final destination.
  • Check with the relevant embassy in advance to see if there’s been any change in passport, visa, or entry requirements.
  • Review any warnings or advice from your country of residence/origin before you go to/through a country or region.
  1. By arranging travel to or from any location, we are not guaranteeing that it is without risk and, to the fullest extent permitted by law, we will not be liable for any resulting damages or losses.
  2. It’s not a common practice, but international law allows “disinfection” of aircraft to kill insects. To do this, personnel might spray the aircraft’s cabin with an aerosol insecticide while passengers are on board, or treat its interior surfaces with a residual insecticide while they’re not on board. Before you travel, we advise you to find out about disinfection, including where it might happen.

Entry/Exit fees

  1. Fees charged by countries or airports to persons entering/leaving the country are not covered by your fare. Before you travel, we advise you to find out if you’ll have to pay this kind of fee.

EU: Passengers’ rights under EU Regulation 261/2004

  1. If your flight is delayed or canceled or you’re denied boarding, you may be entitled to compensation/assistance under EU Regulation 261/2004 if:

– You’re flying into the European Union (EU)

-You’re flying out of the EU

– Your Flight is provided by an EU airline

  1. This section contains the specific terms for Private and Public Transportation products and services. It applies as well as section A (which applies to all Travel Experiences).

F2. Contractual relationship

  1. When you pre-book Private or Public Transportation, your Booking will be directly with the Service Provider. When you book an On-Demand Private Transportation, your Booking will be with the Third-Party Aggregator. In all cases, our Terms will govern the booking process.
  2. Pre-Booked Private Transportation. You and the Service Provider both agree to comply with these Terms.
  3. Public Transportation and On-Demand Private Transportation. You’ll be provided with the Service Provider’s terms during the booking process. If there is any discrepancy between their terms and our Terms, their terms will apply.
  4. On-Demand Private Transportation. By making a Booking, you are confirming that you:

– have read and accept the Service Provider’s terms (where applicable)

– agree to contact the Service Provider directly about anything that goes wrong

– understand that the Service Provider is responsible for arranging and providing your Private Transportation, choosing routes, setting prices, and providing all relevant information

– accept that we just provide a booking platform (known as an API service) and will not be liable for any loss you suffer because of anything the driver/Service Provider does or does not do, except as set out in “Limitation of liability”

– Not all Service Providers have their own terms, but you’re welcome to check out all the terms that we’ve been provided with.

F3. What we will do

  1. We provide the Platform on which Service Providers can promote and sell their Travel Experiences, and you can search for, compare, and book them.
  2. Once you’ve made your Booking, we’ll give the Service Provider your details (e.g. your name, phone number, and pick-up location).
  3. All Private Transportation. We’ll give you the Service Provider’s contact details.
  4. Pre-Booked Private Transportation. We’ll make sure the Service Provider knows what size vehicle you’ve requested.
  5. Public Transportation. We’ll give you (or tell you how to collect) your ticket(s).

F4. What you need to do

  1. You must check the details of your Booking carefully, and provide all the information we need to arrange your Booking (your requirements, contact details, etc.).
  2. You must make sure everyone in your group complies with our Terms and (where applicable) the Service Provider’s terms, which you saw and accepted during the booking process. You acknowledge that if you breach them:

– you might have to pay additional charges

– your Booking might be canceled

– your driver may refuse to transport you.

  1. Bear in mind that estimated journey times don’t take traffic conditions into account.
  2. All Private Transportation. You must make sure all passengers are at the pick-up location on time.
  3. All Private Transportation. At and around your pick-up time, you must have the phone (whose number you entered when booking) turned on and able to receive calls/texts, in case the driver needs to contact you. We can’t guarantee they’ll be able to reach you through messaging applications such as Whats App.
  4. Pre-Booked Private Transportation. For any airport pick-up, you must give us your flight details at least 24 hours before your pick-up time, so your Service Provider can adjust it if your flight is delayed. If they can’t provide Private Transportation following a flight delay or cancellation, contact our Customer Service team.
  5. Public Transportation. You must make sure all passengers arrive on time, leaving enough time to collect tickets if necessary.
  6. You must be 18 or older to make a Booking, and any passenger under 18 must be accompanied by a responsible adult.
  7. You must make sure no passenger behaves inappropriately (e.g. being abusive or doing anything that might endanger someone).
  8. You must make sure you choose Public/Private Transportation that’s suitable (in terms of party size, amount of luggage, accessibility requirements, etc.).

 

 

 

F5. Price and payment

  1. Hangout Dreamspot will arrange the payment for your Booking.
  2. Pre-Booked Private Transportation. Price includes any tolls, traffic charges, taxes, and peak surcharges. Payment is taken at the time of booking.
  3. On-Demand Private Transportation. Price will be confirmed (and payment taken) when your driver drops you off. The price might be different from the price estimated when you booked. You are responsible for any tolls, traffic charges, taxes, peak surcharges, and tips.
  4. Public Transportation. Payment is taken when your Booking is confirmed. Before departure, the Service Provider may need to see your ticket(s)/e-ticket(s). Keep it/them with you at all times, or you might have to pay again.
  5. The Service Provider/driver doesn’t have to agree to any changes to the Journey that you request in person. If they do, they may charge extra.

 

F6. Amendments, cancellations, and refunds

Cancellation

  1. In most cases.

Pre-Booked Private Transportation. You can cancel for free up to 24 hours before your pick-up time (2 hours in some cases – see your confirmation). If you don’t cancel on time, you won’t be entitled to a refund.

On-Demand Private Transportation. You can cancel anytime before your pick-up time, but the Service Provider may charge you a cancellation fee.

Public Transportation. You probably won’t be entitled to a refund once your Booking is confirmed.

  1. If your Service Provider has a different cancellation policy (which you’ll see while booking), their policy will apply instead.
  2. We and/or the Service Provider may cancel the Booking with little or no notice, but this would only happen in very specific situations. For example, if:

the Service Provider becomes insolvent or is genuinely unable to honor your Booking, in which case we’ll do our best to arrange alternative transport (and we’ll refund you in full if we can’t)

you are in breach of these Terms and/or the Service Provider’s terms, in which case you may not be entitled to a refund.

Amendments (changes) before your Journey begins

  1. Pre-Booked Private Transportation. Your confirmation email will tell you how much notice you need to give (ahead of your pick-up time) to request any changes to your Booking (such as location or time).
  2. On-Demand Private Transportation. To change your Booking, you may need to cancel it (which might incur a cancellation fee) and make a new one.
  3. Public Transportation. You can’t change your Booking once it’s confirmed.
  4. If we/the Service Provider need to change your Booking (e.g. a strike that interferes with your journey), we’ll tell you as soon as we can. If you then decide to cancel:

Any Transport. Unless you cancel for one of the reasons in the next bullet, you’ll be entitled to a full refund (no matter how close your journey is).

Any Private Transportation. If the change is simply a new driver, a new Service Provider, or a new (similar) vehicle, you won’t be entitled to a refund (unless you’re canceling with enough notice).

Either way, neither we nor the Service Provider will be liable for any costs you may incur (e.g. alternative transport, hotel rooms).

Refunds

  1. If you want to apply for a refund, you must do so in writing no more than 14 days after your pick-up time.
  2. Any refund may take up to 5 business days to arrive in your account.
  3. All Private Transportation. If your driver isn’t at the pick-up location on time, you can apply for a refund, and we’ll investigate this for you.
  4. All Private Transportation. You won’t be entitled to a refund if your ride doesn’t go ahead as planned because:

– the driver/Service Provider can’t contact you

– one or more passengers isn’t at the pick-up location on time, and you haven’t requested a new pick-up time

– you request unreasonable changes to the pick-up time or Journey

– you don’t tell us/the Service Provider/the driver about a change you want to make

– you’d provided incorrect details when booking your Private Transportation (e.g. pick-up location, contact details, number of people, amount of luggage, etc.).

F7. What else do you need to know?

Pre-Booked Private Transportation

  1. Check your confirmation email to see how long the driver will wait at the pick-up location.

On-Demand Private Transportation

  1. The driver may not wait beyond the pick-up time, If they do, they may charge you for the time spent waiting. If you aren’t at the pick-up location on time, you may be charged a cancellation fee.

Repair or cleaning charges

If anything needs to be repaired or cleaned because someone in your group has done something unreasonable or is in breach of these Terms, you will be responsible for the cost of repairs/cleaning.

Payments

Changing your payment method for a confirmed reservation

If your reservation is confirmed and paid for, you can’t change the payment method. If your stay is for 28 nights or longer, or if you’re using a payment plan, learn how to edit your payment method for upcoming payments.

If you’ve requested to book a listing but the host hasn’t responded yet (the reservation is not confirmed), you can cancel your reservation request and make another request with a different payment method

For some reservations, you may have the option to choose a payment plan.

Something went wrong with your payment

Is your transaction not going through? This can happen for a number of different reasons, including:

– Your credit or debit card has expired

– The billing address or phone number you entered don’t match those associated with your credit or debit card

– The payment method you tried isn’t accepted in your area

– You’ve exceeded the daily withdrawal or purchase limit set by your bank or financial institution

Your credit or debit card doesn’t have sufficient funds to make the payment

– Fraud prevention has been triggered

-Tips to resolve common payment problems

– If your credit or debit card has expired, update your payment method

– Double-check the billing address, ZIP code, and phone number of your credit or debit card

– Make sure the payment method is accepted in your area

– Check that your payment method has been confirmed

– Contact your bank or financial institution to find out why your card might be getting declined.

 

Why is my credit card getting declined?

Credit cards can be declined for a number of reasons. Hangout Dreamspot generally isn’t notified of the specific reason.

Common issues

Check that you’re entering your credit card number and billing address correctly, that your card has available funds, and that your card hasn’t expired.

Contact your bank or card issuer

If you’re getting an error when you try to pay, we recommend reaching out to your bank or credit card company for more information. Inform them of the amount and when tried to make the charge so they can let the transaction go through.

If your bank or card issuer isn’t able to help, you may want to try another payment method.

Confirm your credit or debit card

Sometimes your bank will need to verify it’s actually you making an online payment with your credit or debit card. This verification process uses the 3-D Secure (3DS) authentication framework. Like most online merchants, Hangout Dreamspot will create a process in payment checkout to allow banks to perform 3DS authentication if they want to, and this appears as the Confirm your card screen after you click the Confirm and pay button.

What’s needed

Be sure that you’ve updated your payment security settings with your credit card provider or bank, so that this authentication step happens the way that works best for you. Additionally, make sure your contact information with your credit card provider or bank is up to date.

How it works

Hangout Dreamspot will use  the 3DS framework to contact your card-issuing bank in order to check if they would like to authenticate the payment.

If the bank requires authentication, they will send over an authentication request that Hangout Dreamspot will display for you to complete. This will pop up in the Confirm your card process in the payment checkout screen.

Hangout Dreamspot does not know or control what type of confirmation your bank will present, and it could vary based on the capabilities of the bank.

Once you complete the request as instructed by your bank in the Confirm your card pop-up screen, Hangout Dreamspot will attempt to charge your card.

If you fail or exit out of the Confirm your card authentication request, your bank will not allow your card to be charged and so the payment attempt will fail.

When it’s required

Banks and merchants all over the world may use 3DS for the security of their cardholders.

Strong Customer Authentication is designed to prevent unauthorized use of your card by confirming that you are the one making the payment.

Confirm using your device

You may see an alternate process asking you to use your device to confirm the payment, by taking the same steps you would typically use to unlock your device (ex: face recognition, fingerprint, or device pass-code). This method is optional.

In this version of the Confirm your card process, you may receive a message that “Google Chrome —this is expected.

Using your device to confirm your card will not result in Hangout Dreamspot or any partners collecting your biometric information, such as face or fingerprint images or your device passcode. In fact, that type of information will never leave your phone or device in this authentication process.

Troubleshooting

Unable to complete the authentication challenge

If you’re not getting One-Time Pass-code texts from your bank when confirming your card, or are otherwise unable to complete the request from your bank:

Confirm your payment authentication settings and contact information with your credit card provider or bank.

If your bank security settings appear correct and further payment attempts still fail, consider trying a different payment method.

Hangout Dreamspot dictionary

Account” means an account (with Hangout Dreamspot ), through which you can book Travel Experiences on our Platform.

Accommodation” means the provision of an accommodation service by a Service Provider ( “Service Provider” means the provider of the accommodation service).

Attraction” means the provision of an Attraction service by a Service Provider (“Service Provider” means the provider of the Attraction service).

Attraction service(s)” includes, but is not limited to, tours, museums, attractions, activities, and experiences.

Booking” means the booking of a Travel Experience on our Platform, whether you pay for it now or later.

Hangout Dreamspot,” “us,” “we,” or “our” means Hangout Dreamspot (for accommodation, flights, tours or attractions)

Booking Confirmation” (in the “Car rentals” section) means the confirmation email and coupon we send you, explaining the details of your Booking.

Booking Network Sponsored Ads” means our program that lets Accommodation Service Providers bid through a third party for their product to appear in second place when your search results are ordered by “Our top picks.”

Cash Credits” means a benefit with a monetary value that you can “cash out” to the Payment Method that we have on file for you, or put toward the cost of a future Travel Experience.

Contract of Carriage” means the contract between you and the Service Provider, which deals with your Flight.

Credits” means a benefit with a monetary value. There are “Cash Credits” and “Travel Credits.”

Credit Card Cashback” means a benefit with a monetary value that can be cashed out to the credit card that we have on file for you, but can’t be put toward the cost of a future Travel Experience.

Connectivity Partner” means a company that allows properties and Hangout Dreamspot to communicate accommodation information and customers’ booking data.

Currency Conversion Rate” means the rate that we use to convert currency.

Eligible Booking” means a Booking that meets the criteria to qualify for a Reward.

Flight” means the provision of a flight by a Service Provider.

Intermediation Contract” (in the “Flights” section) means the contract between you and the Third-Party Aggregator, which deals with the way they arrange your Flight ticket (and, in some cases, any extras) with the airline or another company.

Main Driver” means the driver whose details were entered during the booking process.

On-Demand Private Transportation” means a private vehicle that you request when you arrive at the pick-up location (or just before).

Pay In Your Own Currency” means the payment option that we sometimes offer when a Service Provider doesn’t use your currency. This option lets you pay in your currency instead.

Payment Method” means the method used to pay for a Booking, which might be a credit/debit card or an alternative payment method.

Pick-up” (in the “Car rentals” section) means the process at the start of your Rental, when you provide the required ID and other documentation, pay for any fees and additional extras, enter into the Rental Agreement, and collect your car.

Pick-up Time” (in the “Car rentals” section) means the (local) date and time you’re due to pick up your car, as stated in your Booking Confirmation.

Pick-up Time” (in the “Private and Public Transportation” section) means the (local) time when a Pre-Booked Private Transportation is due to reach the pick-up location, or when an On-Demand Private Transportation actually reaches the pick-up location.

Platform” means the website/app on which you can book Travel Experiences, whether owned or managed by Hangout Dreamspot or by a third-party affiliate.

Pre-Booked Private Transportation” means a private vehicle that you request at least 2 hours before you arrive at the pick-up location.

Private Transportation Journey” means the private transportation journey as set out in the Booking (including any changes after the Booking was made).

Public Transportation” means trains, buses, trams, and other types of public transportation.

Public Transportation Journey” means the public transportation journey as set out in the Booking (including any changes after the Booking was made).

Rental” (or “Car Rental”) means the provision of a car by a Service Provider ( “Service Provider” means the rental company that provides the car).

Rental Agreement” means the contract between you and the Service Provider, which you sign at pick-up. You’ll be provided with a summary of the key terms during the booking process.

Rewards” means a benefit that you are promised. In most cases, Rewards will be Travel Credits, Cash Credits, a Credit Card Cashback, or a coupon for an item of some kind.

Service Provider” means the provider of a travel-related product or service on the Platform, including but not limited to the owner of a hotel or other property (for an “accommodation” Booking), a museum or park (for an “attraction” Booking), or a car rental company or airline (for a “transport” Booking).

Services” (in the “Private and Public Transportation” section) means the provision of a Public Transportation Journey or Private Transportation Journey.

Terms” means these terms of service.

Third-Party Aggregator” means a company that acts as either (a) an intermediary between you and the Service Provider or (b) a re-seller of the Travel Experience.

Third-Party Terms” (in the “Flights” section) means both the Inter-mediation Contract with the Third-Party Aggregator (for the ticket) and the Contract of Carriage with the airline (for the Flight itself).

Travel Credits” means a benefit with a monetary value that you can put toward the cost of a future Travel Experience, but can’t “cash out.”

Travel Experience” means one of the travel-related products or services on the Platform.

Upfront Payment” means a payment that you make when you book a product or service, rather than when you actually use it.

Wallet” means a dashboard in your Account that shows your Rewards, Credits, and other incentives.
